These terms and conditions (“the Terms”) govern the users (“you” or “your”) use of the Phoenix Biomedical  website / (“the Website”) and your relationship with Phoenix Biomedical  whose registered office is at phoenixbiomedical.ie, Phoenix Biomedical, 1 Castlehill centre, Carlow R93WP21, . (“we”, “our” or “us”). Please read them carefully as they affect your rights and liabilities under law. If you do not agree to these Terms, please do not access nor use the Website. By using the Website you agree to be bound by these Terms.

We reserve the right to:

We will treat all your personal information as confidential.
When you visit this Website, we may ask you to input personal details in order for us to identify you, such as your name, e-mail address, and permanent address. We confirm that this information will be held by us in accordance with the registration we have with the Data Commissioner’s office.

The Website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and its use. You agree not to upload or transmit through the Website: Any computer viruses or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer; and any material which is defamatory, offensive or of an obscene character.

As a convenience to our customers, the Website may include links to other websites or material which is beyond our control. For your information, we are not responsible for such websites or material nor do we review or endorse them. We will not be liable, whether directly or indirectly, for the privacy practices or content of such websites nor for any damage, loss or offence caused or alleged to be caused in connection with, the use of or reliance on any such advertising, content, products, materials or services available on such external websites or resources.
8.	PRICINGS
All prices shown are inclusive of VAT at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice to you.
9.	INTELLECTUAL PROPERTY
The content of the Website is protected by copyright, trademarks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Website shall remain with us or our licensors.
You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website.

Not withstanding any other provision in the Terms, nothing in these Terms will affect or limit your rights as a consumer under Irish law; or will exclude or limit our liability for death or personal injury resulting from our negligence.
The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Website and any information provided by you. You must bear the risk associated with the use of the Internet.
Whilst we will try to ensure that material included on the Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website. If we are informed of any inaccuracies in the material on the Website we will attempt to correct this as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with the following: Incompatibility of the Website with any of your equipment, software or telecommunications links; technical problems including errors or interruptions of the Website;
unsuitability, unreliability or inaccuracy of the Website; and failure of the Website to meet your requirements.
To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (both of which terms includes, without limitation, pure economic loss, loss of profits, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Website.
11.	LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of Irish and Wales and any disputes will be decided only by the irish courts.
12.	REVIEWS
If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You grant Phoenix Biomedical.ie and its sub-licensees the right to use the name that you submit in connection with such content, if they choose.
You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.
You agree to perform all further acts necessary to perfect any of the above rights granted by you to Phoenix Biomedical   , including the execution of deeds and documents, at the request of Phoenix Biomedical . You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to phoenixbiomedical.ie :
The content and material is accurate;
Use of the content and material you supply does not breach any applicable Phoenix Biomedical .ie guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify phpoenixbiomedical.ie  for all claims brought by a third party against phoenixbiomedical.ie  arising out of or in connection with a breach of any of these warranties.

13.	DELIVERIES

Delivery of products, associated costs and timelines
Delivery prices for orders to Ireland and international are charged by the weight and value of the order. Prices may vary due to international destination of the order. We ensure that all orders placed are dispatched to customers within 1-2 business days, depending on stock availability and final destination. 
If orders are placed before 2.30pm you will receive 1-3 business days delivery in Ireland 
Christmas, Holidays, Bank Holidays – Delayed parcels
Once we have dispatched your items it is the responsibility of the courier or postal service to deliver. We ask that our customers allow 1-5 working days for the delivery items due to unforeseen circumstances such as peak season delays, strike action or chronic weather conditions.
We shall not be held responsible for any delays due to weather conditions or the typical increase in traffic during the holiday seasons.
Discount Codes
Discount codes can only be used singularly and not in conjunction with any other offers.
14. Phoenix Biomedical  recommends you read all equipment and cosmetics instructions before use. 
15. Phoenix Biomedical  reserves the right to refuse admission to salon if the client expresses anti-social behaviour. We also reserve the right to refuse the of use of of our services if no valid ID is shown upon arrival 

16. Booking Deposits

A deposit of €20 for all  services is required to secure your booking. The value of your deposit will be deducted from your services on the day of your appointment. You may change or cancel your booking up to 48 hours before your appointment by logging into our booking system from our website. Any cancellations within 48 hours, or failure to show up to your appointment will result in your forfeiture of your deposit, without exceptions. 

17. Cancellation policy:
We require at least 48 hours notice for any cancellations and changes to your appointment. Cancellations within 48 hours, or failure to show up to your appointment will result in your forfeiting your deposit, without exception. We reserve the right to cancel your appointment at any time.

18. Deposit refunds
Deposits are not refundable. Deposits for cancelations outside of 48h grace period will be credited to your account in the clinic and can be used for future purchases of services. Credited deposits are not redeemable for products. Unfortunately, we cannot take any personal circumstances into account, we have one policy for all clients and will not make any exceptions on this. 

19. Product Refunds
At  Phoenix Biomedical we offer returns or exchanges within 14 days of purchase once products are returned unopened. Your right to cancel under the Consumer Rights Directive starts from the moment you receive your order. Faulty or damaged goods will be replaced once we are contacted within 7-days of receiving your package. You can return your product in exchange for store credit, a different product, or a refund to the original payment method used. Phoenix Biomedical is under no legal obligation to provide a refund prior to receiving proof of items being returned or after the 14 day "cooling-off period" is expired. 
If you just change your mind and want to exchange for alternative products this is completely fine, however you are responsible for postage costs to both return products, and for postage costs associated with the provision of new products. 

Please note the following exceptions to our return and refund policy:
	Discount or promotional sales are final and cannot be returned or exchanged.
	Returned items must be unopened.
	Seal must not be opened or tampered with.
	Product must remain in its original packaging.
	Returned items must have no visible signs of wear or use or damaged packaging.

Please note: if unwanted goods are not returned in perfect condition, a refund will not be provided. Therefore, please package returns appropriately as we will not be held accountable for items damaged in transit. 


20. Treatment refunds
For treatments already provided, no refund is possible. Results vary from client to client and all potential outcomes of any treatment will be discussed in advance of the treatment being performed. No result can be fully determined ahead of the treatment taking place, hence why most treatments require a consultation in advance in order to discuss the treatment in detail and set the expectation for the client. 

21. Partial refunds for packages of treatments.

Packages of treatments that have not been fully completed may be eligible for refund or in clinic credit for other treatments but not products. This will be considered on case by case basis. To be eligible for a refund you must apply for a refund within 14 days from purchase date. The sum of refund is equal to cost of package – full price of treatments completed in the clinic.

Example: 
Full Price of Laser treatment is €220.  A package of 3 treatments is €600 (reduced price as part of the full package). Provided you have changed your mind about purchase of course of treatments within 14 days of purchase date,  but have already completed one session; You may be considered eligible for a refund of funds or in clinic credit with accordance to policy above.  Your refund will be equal to cost of package minus full cost of treatments already completed. In this case €600 - €220  (1 full price treatment) = €380 of funds refund or in clinic credit for further treatments.
